Last Friday’s court verdict on the Ashton Asoke case has ignited a similar complaint against another condo project on Soi Yen Akat in Yannawa district, with a request to suspend the construction permit issuance.
The Quintara Sync Yen Akat is a new low-rise condo developed by Eastern Star Real Estate Plc. Construction has not started.
Torsak Lertsrisakulrat, managing director of Eastern Star, said in a statement that the project’s details submitted for the construction permit were all verified by relevant government agencies.
The project’s environmental impact assessment (EIA) report was approved, offering transparency and using the best legal practices, said Mr Torsak.
“We conducted two public hearings with neighbouring communities and learnt about their complaints. The concern is with the road’s width in front of the project,” he said.
The developer said it reexamined and remeasured the road and got a verification document from all related agencies to reconfirm that the development plan for large-scale towers no higher than eight storeys and a total area not exceeding 10,000 square metres can be done.
At the same time, the developer revised the project’s design by cutting the total number of units earlier planned from 379 to 349 units and reducing the total number of towers from three to two.
To minimise impact on sun shade and wind, it cut the number of floors at one tower which will be located close to one of the complainants from eight to three.
“Despite getting an EIA report approval, construction has not started as we want all parties to be happy and have mutual understanding as much as possible before starting construction,” said Mr Torsak.
According to Eastern Star’s 2020 annual report, the project was notified as “Yenakat Land” sized 3-2-14 rai with a land value of 537 million baht.
It had an obligation to a financial institution with a registered mortgage of 879 million baht.
Korn Chatikavanij, Kla Party leader and one of the Quintara Sync Yen Akat complainants, filed a complaint to Bangkok’s governor on Aug 3, a few days after Ashton Asoke’s verdict.
Mr Korn, also a former finance minister, and other complainants or the project’s neighbours asked the governor to suspend construction permit issuance for the Quintara Sync Yen Akat project as they disagreed with the EIA report approval.
They said the road’s width in front of the project along the route was lower than the Building Control Act’s regulations.
If the project is allowed to move forward, it will cause traffic problems in the area.
“If the construction permit is issued, we will sue them through the administrative, civil and criminal courts,” said Mr Korn.
